These terms and conditions apply to all bookings, offers and agreements with Dune Callantsoog.
Article 1 – Definitions
1.1 Landlord: [Company name / owner name], established at [address], [postcode] Callantsoog, registered with the Dutch Chamber of Commerce under number [KvK number], hereinafter: “Dune Callantsoog”.
1.2 Tenant: the natural person who books an accommodation with Dune Callantsoog other than in the course of a profession or business.
1.3 Accommodation: Strandhuis Dune or Penthouse Dune, located at [address(es)], Callantsoog.
1.4 Booking: the agreement between tenant and landlord for a temporary paid stay in the accommodation.
1.5 Stay period: the period from the arrival date up to and including the departure date as stated in the booking confirmation.
Article 2 – Applicability
2.1 These terms and conditions apply to all bookings, offers and agreements with Dune Callantsoog.
2.2 Deviations from these terms are only valid if agreed in writing.
2.3 By placing a booking, the tenant declares that they have read and accept these terms.
Article 3 – Formation of the booking
3.1 A booking is formed once Dune Callantsoog has confirmed it in writing (including by email) and the (down) payment referred to in article 4 has been received.
3.2 At the time of booking the tenant must be at least [18/21] years old and is jointly and severally liable for all fellow guests.
3.3 The accommodation may only be occupied by the number of persons stated in the booking, with a maximum of [X] persons for the Strandhuis and [X] persons for the Penthouse. Exceeding this may lead to termination of the agreement without refund.
3.4 Obvious errors or mistakes in offers, prices or the booking confirmation are not binding on Dune Callantsoog.
Article 4 – Prices and payment
4.1 The rental price is stated in the booking confirmation and includes [VAT, energy costs, wifi] and excludes [tourist tax, linen, final cleaning].
4.2 On booking, the tenant pays a deposit of [30/50]% of the total rental sum. The balance must be paid no later than [4/6] weeks before arrival.
4.3 For bookings made within [4/6] weeks of arrival, the full rental sum is due immediately.
4.4 In the event of late payment, Dune Callantsoog is entitled to cancel the booking; the cancellation provisions of article 6 then apply.
4.5 Dune Callantsoog may require a security deposit of €[X]. This is refunded within [14] days after departure, less any damage, missing items or additional cleaning costs.
Article 5 – Right of withdrawal
5.1 The statutory right of withdrawal (cooling-off period) for distance contracts does not apply to bookings of holiday accommodation for a specific stay period (article 6:230p sub e of the Dutch Civil Code). Cancellation is only possible in accordance with article 6.
Article 6 – Cancellation by the tenant
6.1 Cancellation must be made in writing (by email). The date of receipt counts as the cancellation date.
6.2 In the event of cancellation, the tenant owes the following compensation:
- up to [8] weeks before arrival: [30]% of the rental sum;
- from [8] to [4] weeks before arrival: [60]% of the rental sum;
- from [4] to [1] week(s) before arrival: [90]% of the rental sum;
- within [1] week before arrival or in the event of a no-show: [100]% of the rental sum.
6.3 Amounts already paid in excess of the compensation due are refunded within [14] days.
6.4 Dune Callantsoog advises the tenant to take out cancellation insurance.
6.5 Early departure does not give any right to a (partial) refund.
Article 7 – Cancellation or change by the landlord
7.1 If, due to unforeseen circumstances or force majeure (including fire, water damage, serious technical defects or government measures), Dune Callantsoog cannot make the accommodation available, the tenant will be informed as soon as possible.
7.2 In that case Dune Callantsoog will, where possible, offer an equivalent alternative. If the tenant does not accept this, or no alternative is available, all amounts already paid will be refunded in full.
7.3 Any further liability of Dune Callantsoog for damage or costs (such as travel or replacement costs) is excluded, except in the case of intent or gross negligence.
Article 8 – Arrival, departure and stay
8.1 Check-in is possible from [15:00] on the day of arrival; check-out no later than [10:30] on the day of departure, unless otherwise agreed.
8.2 The tenant shall use the accommodation with due care, solely for recreational stay. (Sub)letting to third parties, holding parties and commercial use are not permitted.
8.3 Smoking is not permitted anywhere in the accommodation. [Pets are not permitted / permitted only by prior arrangement, subject to a surcharge of €X.]
8.4 Quiet hours apply between [22:00] and [08:00]; nuisance to neighbours is not permitted during the day either.
8.5 On departure the tenant leaves the accommodation broom-clean: [dishes done, waste removed, beds stripped].
8.6 In the event of serious or repeated breach of the house rules, Dune Callantsoog may terminate the agreement with immediate effect without refund of the rental sum.
Article 9 – Liability of the tenant
9.1 The tenant is liable for all damage to the accommodation and its contents caused during the stay period by the tenant or fellow guests, unless the tenant demonstrates that the damage cannot be attributed to them.
9.2 Damage must be reported to Dune Callantsoog immediately and, insofar as it is not covered by the tenant’s insurance, is compensated by the tenant.
9.3 Loss of keys is charged at [€X / the actual replacement costs, including any necessary lock replacement].
Article 10 – Liability of the landlord
10.1 Staying in and around the accommodation is at your own risk. Dune Callantsoog is not liable for:
- a. loss, theft or damage to the tenant’s property;
- b. personal injury of the tenant or fellow guests;
- c. malfunctions or temporary failure of facilities (such as wifi, TV, hot water) through no fault of Dune Callantsoog;
- d. nuisance caused by third parties, construction work in the area or weather conditions.
10.2 The exclusions in paragraph 1 do not apply if the damage is the result of intent or gross negligence on the part of Dune Callantsoog, nor insofar as mandatory consumer law opposes the exclusion.
10.3 In all cases the liability of Dune Callantsoog is limited to a maximum of the rental sum paid, except in the case of intent or gross negligence.
Article 11 – Force majeure
11.1 Force majeure means any circumstance beyond the will and influence of Dune Callantsoog that temporarily or permanently prevents performance of the agreement, including natural disasters, extreme weather, fire, government measures, epidemics/pandemics and failure of utilities.
11.2 In the event of force majeure, article 7 applies accordingly.
Article 12 – Complaints
12.1 Complaints about the accommodation must be reported to Dune Callantsoog during the stay, so that there is an opportunity to resolve the complaint.
12.2 Complaints reported only after departure can no longer be remedied on site and in principle do not give any right to compensation, unless the tenant could not reasonably have complained earlier.
12.3 If a complaint is not resolved satisfactorily, the tenant may submit the complaint in writing within [14] days after departure via [email address]. Dune Callantsoog will respond within [14] days.

Article 13 – Personal data
13.1 Dune Callantsoog processes the tenant’s personal data solely for the performance of the booking and in accordance with the privacy statement on [website], in compliance with the GDPR.
Article 14 – Applicable law and disputes
14.1 Dutch law applies to all agreements.
14.2 Disputes are submitted to the competent court in the district of [Noord-Holland], unless mandatory law provides otherwise. The tenant (consumer) always has the right to choose the court designated by law within one month after Dune Callantsoog has invoked this clause in writing.
Article 15 – Final provisions
15.1 If any provision of these terms proves to be void or voidable, the remaining provisions remain in full force. The void provision will be replaced by a valid provision that comes as close as possible to its intent.
15.2 Dune Callantsoog is entitled to amend these terms. For existing bookings, the version that applied at the time of booking remains in force.
